Following the ECJ decision on the Achmea vs Slovak Republic case (C 284/16) that ruled that arbitral investment clauses in that intra-EU Bilateral Investment Treaties are contrary to EU law, Malta together with the other EU Member States have committed to terminate their intra-EU BITs, as per the Declarations of the Representatives of the Governments of Member States of 15 and 16 January 2019 on the legal consequences and enforcement of the Achmea judgment and on investment protection in the European Union
