Agreement was terminated with effect from 22nd May 2020​ Following the ECJ decision on the Achmea vs Slovak Republic case (C 284/16) that ruled that arbitral investment clauses in that intra-EU Bilateral Investment Treaties are contrary to EU law, Malta together with the other EU Member States committed to terminate their intra-EU BITs, as per ‘Declaration of the Member States of 16 January 2019 on the enforcement of the judgement of the Court of Justice in Achmea and on investment protection in the European Union’. Malta and Sweden bilaterally terminated the Bilateral Investment Treaty between them on 1st May 2004.
