Memorandum of Understanding
The ECJ decision on the Achmea vs Slovak Republic case (C 284/16) ruled that arbitral investment clauses in that intra-EU Bilateral Investment Treaties are contrary to EU law. Malta together with Cyprus have ratified the Agreement for the Termination of Bilateral Investment Treaties between the Member States of the European Union, which was signed in Brussels on 5 May 2020.
